Terms & Conditions of Miss Moda Hire

Upon engaging in services provided by Miss Moda Hire you are accepting and consenting to the practices outlined in these terms and conditions

OVERVIEW


Throughout our social media, the terms "Miss Moda Hire", “we’, “us” and “our” refer to Miss Moda Hire (ABN 69852964765). The terms “you” and “your” refer to all users and consumers of this social media.

By browsing our social media and website visiting our store, viewing our profile and/or purchasing goods, you engage in our service and agree to be bound by the following terms and conditions referenced herein.

You represent that you are at least the age of majority in your state, or have reviewed and accepted these terms and conditions with your parent or guardian. We will assume that this is the case, and provide our services on this basis.

A breach to or violation of any of the terms and conditions will result in immediate termination of our services.

We reserve the right to refuse service to anyone for any reason at any time.

Miss Moda Hire reserves the right to update, change or replace any part of these terms and conditions. 


Your continued use of or access of our services following any changes constitutes acceptance of those changes.

Please read these terms and conditions carefully before accessing or using our services. If you do not agree to all the terms and conditions of this agreement, then you may not access any services.

 

1.0 Commitment & Responsibilities 

1.1 As a client of Miss Moda Hire your commitment is to uphold the terms and conditions as set forth.

2.0 Products and Pricing 

2.1 Products are subject to availability.


2.2 Prices for our products are subject to change without notice.


2.3 We reserve the right at any time to modify or discontinue the service without notice.


2.4 We shall not be liable for any modification, price change, or discontinuation of the service.

 

 

3.0 Hire Orders

3.1 Hire orders may be placed directly through our website.


3.2 We do not offer holds on products.

3.3 Hire orders come into existence once payment is made.

3.4 Miss Moda Hire reserves the right to accept or reject your offer for any reason including, without limitation, the client’s history, the unavailability of any product, and/or an error in the order placement.

3.8 If an outfit is not picked up, you will not receive a refund or store credit. 

 

4.0 Garment Exchange 

4.1 At Miss Moda Hire we offer a complimentary Garment Exchange option.

4.2 Clients are welcome to exchange the chosen product for another, twice between order placement and pick up date.


4.3 Payment made towards the initial product are retained on the order and applied to the exchange.

4.4 Garment exchange is subject to availability.

4.5 The excess amount not used on refund is not subject to refund or store credit.

 

5.0 In-Store Try On

We offer 30-minute try on appointments in Mt Gravatt  QLD, 4122.

5.1 Miss Moda Hire requires a $15 upfront fee to book a Try On Appointment.

5.2 The $15 fee will go towards the garment price when hired. This $15 is NON-REFUNDABLE if the client does not hire a garment. 

5.3 Request an appointment through Instagram DM/email.

5.4 The $15 credit from try on is only redeemable to the item booked for in the try on


6.0 Appointment Cancellation Policy


6.1 When booking an appointment with Miss Moda Hire you agree to our Cancellation Policy.

6.2 We ask that you offer at least 12 hours notice of cancellation to respect our business and customers. Where less than 12 hours notice is given we can offer a rescheduling to another date/time. Where no notice is given prior to the appointment the $15 will not be refunded. We appreciate your understanding. 
 

7.0 Order Cancellation 

7.1 Orders may be cancelled at any time. Where cancellation occurs, store credit will be issued.

7.2 All payments are final, and as such non-refundable. 

7.3 Where notification of cancellation is received less than thirty [30] days prior, store credit will be issued minus any charges incurred on the preparation of the order including but not limited to, alterations, dry cleaning, and/or shipping fees.

7.4 Store Credit is not applicable where cancellation occurs following the commencement of the Hire Period. 

7.5 Miss Moda Hire is not responsible for cancellations regarding garment size/fit, and/or change of mind.

7.6 We recommend the use of our try on services, available to the client in-store.

7.7 Store Credits are active for 12 months, from date of issue.

 

8.0 Event Postponement and Permanent Event Cancellation 

8.1 Where cancellation occurs due to circumstances brought about by Covid-19, for example, government cancellation of an event due to public health, a store credit with extended terms will be issued to the client.

8.2 Our response regarding Covid-19 has been compiled following guidelines issued by the ACCC. Australian Competition and Consumer Commission.


8.3 Should your event be postponed due to Government Restrictions, a Store Credit will be issued against your cancelled order.

 

9.0 Garment Unavailability

9.1 In the event your garment is unavailable for the revised date, you're able to apply your credit to another garment or retain store credit for future use with extended terms.
 

10.0 Permanent Event Cancellation

10.1 In line with the ACCC advice, when an event is cancelled due to government decision, we will offer a store credit only.
 

11.0 Hire Period and Return

11.1 The hire period commences when the client collects the hire order.

11.2 Upon receiving the product, the client accepts full responsibility for safekeeping during possession.

11.3 Miss Moda Hire retains ownership of the product.

11.4 Return is due on the 4th day of the hire by 4pm. 

11.5 Where hire orders are not returned by 4pm on the agreed date, Miss Moda Hire may charge additional fees until returned ($20). The client authorises Miss Moda Hire to deduct and/or charge such additional fees. 

11.6 Such additional charges pertaining to return shall be charged at a fixed fee of $20.00 for each day overdue. 

11.7 If the client does not return within 3 days after the return date, Miss Moda Hire will deem non-returned and will charge 100% of the retail price additional to late fees incurred. Police report will be filed in clients name for theft, and charged sent to debt collecting agency if refuses to make payment.

12.8 The client will additionally be charged with any lost bookings.

12.9 Under any circumstances where postage is applicable (organised from owner of Miss Moda Hire and not client),  client agrees that they solely undertake all responsibility of the item once shipped. If lost, damaged or stolen, client understands they must may full rrp for item as listed on website and price of hires impacted.

12.10 Item must be shipped by handing over the counter at AUS POST by 3pm the first business day after the formal (e.g Monday after Saturday hire). Miss Moda Hire is able to see the times where garments have been posted back due to tracking numbers. Failure to do this will result in late fees. 

12.11 Where client does not ship before 3pm OR a day late resulting in delay of post returning, they are eligible to pay for the hire’s impacted and late fees.

12.12 In cases where no payment is made to fix or pay rrp for the garment, your details will be forwarded to the 'Debt Collection Agency.' You will be solely responsible  for any fees associated with this and will have a police report filed in your name for theft. 

12.13 Where client refuses to post back dress, details will be forwarded to the 'Debt Collection Agency.' You will be solely responsible for any fees associated with this and will have a police report filed in your name for theft. 

12.14. Shipping dress interstate and within QLD, without the knowledge of MMH will result in the termination of our services for client, including social media. Client will pertain fees for $20 each day item was engaged with post. Where no payment is made, client details will be forwarded to debt collecting agency. 

12.0 Garment Care and Cleaning

12.1 Miss Moda Hire solely undertakes all activity pertaining to cleaning and alterations of products.

12.2 The client agrees they will not attempt to clean, iron or alter the product in any way.

Please note: All garments are hire items. This means that our products have been worn by other consumers prior to your hire. Although we strive to uphold the best quality garments, minor signs of wear and tear may be present. Minor signs of wear and tear will NOT be eligible for a refund or store credit. It is important to read the description of the item listed on the website before making payment.

12.3 If a garment is returned in poor condition, is damaged or requires extra professional cleaning, you, as the client, will be responsible for ALL repair costs and will be required to pay the full RRP replacement fee if damage is beyond repair and garment is no longer able to be hired out in appropriate condition.

12.4 If client is liable to pay the rrp due to damages, they do not receive dress upon payment.

12.5 If client refuses to pay additional cleaning and mending fees, full rrp will be charged. 

12.5 If Item is stolen, full rrp value stated on website is to be paid directly to Miss Moda Hire.

12.6 If another hire is impacted by the damage, or extra cleaning is required leading to cancellation of other hires, the client will be required to pay any resulting lost hire fees on top of the rrp.

12.7 If client refuses to pay rrp after damage and time frame, details will be sent to a debt collecting agency and police report will be filed. 

 

13.0 Bonds

13.1 For the circumstance of interstate bookings, or orders made before July 2024 a refundable bond is applied at checkout.

13.2 Miss Moda Hire, has the ability to hold this bond and use it if garment is not returned in good condition.

13.3 Please allow upto 10 business days for bond to be refunded once hire is returned. 

 

14.0 Pick Up 

14.1 You will receive an email asking to contact us to organise pick up.

14.2 If no contact is received within 24 hrs your order will be cancelled and store credit will be given. Under no circumstances, will a refund be given.

15.0 Payment

15.1  By purchasing from our store and entering this agreement, you authorise Miss Moda Hire to charge the selected payment method according to the terms outlined in this agreement. 

15.2 You certify that you are authorised to use this credit card/account and you agree not to dispute the payment with your provider if Miss Moda Hire fulfils its responsibilities in providing the rental item(s).

15.3 You also authorise Miss Moda Hire to charge the supplied payment method (card on file) for any additional fees as outlined in this agreement (such as damages or late return fees). If a charge against the supplied payment method cannot be made, we will provide you with an invoice for the fees which you agree to pay within 1 working day

15.4 If you make payment without checking if dates are available, you are not eligible for a refund, only store credit.

15.5 You acknowledge that your address is given in order the payment to be processed by shopify,  and Miss Moda Hire does not hold this information.

 

INDEMNIFICATION

You agree to indemnify and hold Miss Moda Hire harmless from any claim or demand including reasonable fees arising out of your breach of these terms and conditions.

 

This is a legally binding document. When selecting “ I agree to the terms and conditions,”  you agree that the information you have provided is correct and you will follow the above information.
